These terms apply when you visit kofiamoa.com, submit an inquiry, purchase artwork, book portrait services, access a private client portal, review proofs, download images, or otherwise work with Kofi Amoa. By using the site or a private client gallery, you agree to these terms.

Who We Are

This site and the related client portals are operated by Kofi Amoa, a photographic artist based in Northern California. Questions about these terms can be sent to kofi@kofiamoa.com.

Scope Of These Terms

These terms are intended to cover both fine art sales and portrait-related services. Some projects may also be governed by a written proposal, invoice, portrait agreement, print order, license, or client communication. If there is a conflict, the more specific written agreement for that project or order controls.

Artwork, Prints, And Editions

Fine art prints, limited editions, framed works, and related products are sold subject to availability, edition status, production requirements, and confirmation of final specifications. Sizes, materials, framing, pricing, and fulfillment timelines may vary by piece and order.

Because many artworks are produced to order, final sale terms, returns, exchanges, shipping responsibilities, and production timelines will be confirmed before purchase or stated on the applicable invoice or checkout page.

Portrait Sessions And Client Services

Portrait sessions, creative direction, image selection, retouching, delivery, print products, and related services are governed by the terms stated in the applicable proposal, invoice, booking confirmation, or portrait agreement.

Unless otherwise stated in writing, session fees, retainers, deposits, and custom production fees reserve time and cover creative services. They may be non-refundable once work has been scheduled, performed, or production has begun.

Client Portals And Private Galleries

Private galleries and client portals are provided for review, selection, proofing, delivery, and communication. Access is intended only for the client and any people the client has permission to share access with.

You may not scrape, copy, publicly repost, commercially exploit, alter, remove watermarks from, or distribute images from a private gallery unless those rights have been granted in writing.

Copyright And Image Use

All photographs, artwork, website content, designs, text, and related materials are owned by Kofi Amoa unless otherwise stated. Purchasing a print, downloading a file, receiving a proof, or commissioning a portrait session does not transfer copyright.

Image use rights are limited to the license or permission granted in writing. Personal-use portrait downloads may generally be used for personal sharing, personal printing, and non-commercial display, unless otherwise restricted. Commercial, editorial, advertising, brand, resale, AI training, product, publication, or third-party use requires separate written permission.

Proofs, Edits, And Final Images

Proofs are unfinished review files and may not represent final color, retouching, crop, resolution, or print quality. Final delivered images may differ from previews due to editing, production decisions, print materials, display calibration, and crop or size requirements.

Requests for additional retouching, alternate crops, rush delivery, custom sizing, re-edits, reprints, or expanded licensing may require additional fees.

Orders, Payment, And Fulfillment

Orders are not final until accepted and paid according to the applicable invoice, checkout page, or written confirmation. Prices may change before an order is confirmed. Taxes, shipping, framing, installation, rush processing, and third-party production costs may be charged separately where applicable.

Fulfillment timelines are estimates unless expressly guaranteed in writing. Delays may occur because of print production, framing, shipping carriers, supplier availability, client approvals, or other factors outside direct control.

Cancellations, Rescheduling, Returns, And Damage

Cancellation, rescheduling, refund, and return terms may vary by service, product, and project. Custom artwork, commissioned work, digital files, framed pieces, limited editions, and completed services may be final sale or non-refundable unless otherwise stated in writing.

If an artwork or print arrives damaged, contact kofi@kofiamoa.com promptly with photographs of the packaging and damaged item so the issue can be reviewed with the printer, framer, or carrier.

Accuracy And Availability

We aim to keep site information accurate, but errors can occur. Images, colors, scale, availability, pricing, descriptions, edition status, dates, and service details may be corrected or updated at any time.

Third-Party Services

The site and client experience may use third-party services for hosting, forms, analytics, email, galleries, proofing, payments, printing, framing, delivery, or client access. Those services may have their own terms and privacy policies.

Privacy

Use of this site and related client portals is also subject to the Privacy Policy, which explains how information is collected and used.

Limitation Of Liability

To the maximum extent permitted by law, Kofi Amoa is not liable for indirect, incidental, consequential, special, or punitive damages arising from use of the site, client portals, artwork, services, downloads, or third-party platforms. Total liability for any claim is limited to the amount paid for the specific product or service giving rise to the claim.

Changes To These Terms

These terms may be updated occasionally. The date at the top of this page reflects the most recent revision. Continued use of the site or client portals after updates means you accept the revised terms.

Governing Law

These terms are governed by the laws of the State of California, without regard to conflict-of-law principles, unless a specific written agreement states otherwise.
